      A plea of self-defense at the examining trial of Dr. H. E. Martin Friday on a charge of murdering his wife's parents was indicted today in a statement attributed to Martin by Sheriff Edwin France: "It was either him or me. I happened to be lucky." The sheriff said the 51-year-old physician made the statement 10 him shortly after the fatal shooting of Lee Grant McNichols, 58, owner of extensive farm lands in Christian county, and Mrs. Lula McNichols, 52, at the Martin home in nearby La Fayette Sunday. Although no charge was placed against her, Mrs. Martin, 31, the former Beulah McNichols, was under $3,000 bond to appear at her husband's hearing. The sheriff said Martin had expressed fear brothers of both the slain p;rsons might "try to get even" and had told him at the jail: "I am afraid please keep me safe and dont let anybody in to see me." France said the doctor and his wife had quarreled, and that when the McNichols arrived at the Martin home in response to a summons from Mrs. Martin, the doctor shot McNichols once and Mrs. McNichols twice from his doorway. Mrs. McNichols was struck as she leaped in front of her husband, the sheriff said. McNichols fired two shots through the door, rushed into the house, disarmed Martin and struck him on the head with his pistol, then fired another bullet which created Martin's scalp, the sheriff continued. McNichols walked to a nearby store, drank a "soda," assisted in carrying his wife to a doctor's office, where she died, and then drove 18 miles to a Hopkinsville hospital before succumbing to his wound, the sheriff reported. The sheriff said Martin had performed "target practice" with his wife's hat and a .22 calibre rifle in their home Sunday morning.

      Charging "cruel and inhnman treatment" said declaring that her husband was drunk much of the time for a year or more, Mrs. Beulah McNichols Martin, 33, filed suit for divorce In Christian circuit court and asked $10,000 alimony from Dr. H. E. Martin, physician at La Fayette. The suit Is the second for Mrs. Martin, who asked a divorce in November, 1937, a few days after Dr. Martin was Jailed in the fatal shooting of his wife's parents, Mr. and Mrs. L. G. McNichols. She later dismissed the suit. Dr. Martin was acquitted of slaying his father-in-law on grounds of self-defense and a murder charge to the slaying of his mother-in-law tos dismissed by the commonwealth.
